1. Agreement to Terms

By accessing or using the website qlarityads.com or engaging Qlarity Ads for any services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our website or services.

Qlarity Ads is a freelance digital marketing service operated by an individual based in Bangalore, India.

2. Services Offered

Qlarity Ads provides the following digital marketing services:

  • Meta Ads (Facebook & Instagram advertising)
  • Google Ads (Search, Display, Performance Max)
  • Bing Ads (Microsoft Advertising)
  • Google Business Profile Management
  • Website Design & Development

All services are subject to a separate service agreement or proposal agreed upon between Qlarity Ads and the client prior to commencement of work.

3. Free Strategy Call

The free 30-minute strategy call offered on our website is a no-obligation consultation. Booking a call does not constitute entering into a service agreement. We reserve the right to decline services to any potential client at our discretion.

4. Payment Terms

Payment for services is accepted via PayPal or bank transfer. The following payment terms apply:

  • Specific payment schedules are outlined in individual client proposals
  • Invoices are due within the timeframe specified in the proposal
  • Late payments may result in suspension of services
  • All fees are non-refundable unless otherwise stated in writing
  • Prices are quoted in INR for Indian clients and USD for international clients unless agreed otherwise

5. Client Responsibilities

To enable us to deliver our services effectively, clients agree to:

  • Provide timely access to ad accounts, analytics, and required platforms
  • Supply accurate business information and marketing materials
  • Respond to communications within a reasonable timeframe
  • Ensure their business, products, and services comply with Meta, Google, and Microsoft advertising policies
  • Provide sufficient ad budget as agreed in the service proposal

6. Results Disclaimer

While we work hard to deliver the best possible results, Qlarity Ads does not guarantee specific outcomes such as a particular ROAS, number of leads, or revenue figures. Digital advertising results depend on many factors including market conditions, ad budgets, competition, and the quality of the client's product or service.

Past results shown on our website are real but are not a guarantee of future performance.

7. Intellectual Property

All content on qlarityads.com including text, graphics, logos, and images is the property of Qlarity Ads and may not be reproduced without written permission.

Creative assets produced for clients during the engagement (ad creatives, website designs) become the property of the client upon full payment of all outstanding invoices.

8. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive business information shared during the engagement. Qlarity Ads will not disclose client data, ad performance metrics, or business information to third parties without written consent, except where required by law.

9. Termination

Either party may terminate the service agreement with written notice as specified in the individual client proposal. Upon termination:

  • All outstanding invoices become immediately payable
  • Access to ad accounts and assets will be returned to the client
  • Work completed up to the termination date will be delivered
  • Prepaid fees for work not yet commenced may be refunded at our discretion

10. Limitation of Liability

To the maximum extent permitted by law, Qlarity Ads shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or website. Our total liability to any client shall not exceed the total fees paid by that client in the 3 months preceding the claim.

11. Third-Party Platforms

Our services involve managing campaigns on third-party platforms including Meta, Google, and Microsoft. We are not responsible for changes to these platforms' policies, algorithms, or pricing that may affect campaign performance. Ad spend budgets paid directly to these platforms are non-refundable by Qlarity Ads.

12. Governing Law

These Terms & Conditions are governed by the laws of India. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

13. Changes to These Terms

We reserve the right to update these Terms & Conditions at any time. Changes will be effective immediately upon posting to this page. Continued use of our website or services after changes constitutes acceptance of the updated terms.
